Abstract

Досліджено теоретичні аспекти релігійних норм, як соціально-правотворчих чинників суспільства; чітко визначено та охарактеризовано форми впливу релігійних норм на правотворення, зокрема виділяються: просторова (територіальний та соціальний аспект), опосередкована, безпосередня, вибіркова та смислова.Исследовано теоретические аспекты религиозных норм как социально правотворческих факторов общества; четко определены и охарактеризованы формы влияния религиозных норм на правотворчество: пространственная (территориальный и социальный аспект), опосредованная, непосредственная, избирательная и смысловая.The article describes the cultural phenomenon in close relationship with religious norms. The law becomes universal and necessary phenomenon of world culture which is a condition of harmonious development of the legal system based on universal spiritual values of mankind due to interference of religious and legal norms in lawmaking process. It takes into account the national specifics but based on the undisputed recognition of freedom and democracy values. The article provides theoretical aspects of religious norms as social lawmaking factors of society; It is and described forms of influence of religious norms on forming law: spatial (territorial and social aspect), indirect, direct, selective and semantic. The influence of religious norms on the creative process is particularly important in the context of globalization, as a result of active convergence of different legal systems, cultures and traditions there is an objective need for a common cultural and legal basis for the interaction of different countries, societies, groups, communities etc. This law can be more critically affect the public consciousness and society, through an optimal combination of sound and content negotiation of legal and religious norms, based on comprehensive scientific and theoretical justification and proof.
